BACKGROUND:

Attached is the annual retention agreement with the firm of Foley, Baron, Metzger, and Juip, PLLC for legal assistance related to the legal compliance obligations for the former Cliffs-Dow site.

The City has had an outstanding relationship with this firm over the past 10 plus years and relied upon them for all legal matters that arise regarding the former Dow site.

FISCAL EFFECT:

Funds for the retention agreement are available in the FY 2023-24 budget.

RECOMMENDATION:

Approve the agreement as presented, and direct City staff to execute the agreement.

ALTERNATIVES:

As determined by the Commission.
