The City has received participation forms for new national opioid settlements from the Teva National Settlement, Allergan National Settlement, CVS National Settlement, and Walmart National Settlement. These settlements would resolve all opioid litigation brought by states and local political subdivisions against these companies. If the City of Marquette chooses to participate, it will receive direct payments from these settlements.
The Settlements also contain injunctive relief provisions governing the opioid marketing, sale and distribution practices at the heart of the states' and subdivisions' lawsuits and further require the Distributors to implement additional safeguards to prevent diversion of prescription opioids.
Also up for consideration is the proposed Michigan State-Subdivision Agreement for these settlements. This document determines the distribution between the State and Local Subdivisions, and it determines the allocation amount to each Local Subdivision. This Agreement is in the process of ratification.
The City Commission previously approved participation in similar settlements at their regular meeting on December 20, 2021.
In order to participate in the settlements, a municipality must “opt in” by April 18, 2023. The City is estimated to receive $45,474 over the course of 13 years from these settlements.
