For decades, the City of Marquette has utilized a municipal ordinance violations bureau to process municipal civil infraction violation notices, pursuant to state law (MCL 600.8707). The law stipulates that these violation notices can be issued by "authorized local officials".
The attached ordinance would amend Chapter 30, Article II of the Marquette City Code in order to:
- Clarify and expand the list of City officials authorized to issue municipal civil infraction citations and violation notices.
- Remove sections of the Article that reference the fine amounts for civil infractions, as these fines are set via the annual City fee schedule.
- Remove sections of the Article that are redundant with state law.
Also attached is a version of Article II with the recommended changes reflected, as well as a clean copy of Article II with the changes incorporated.
Per City Charter, this ordinance cannot be adopted at the meeting in which it is introduced. This item should be moved to the April 10 meeting agenda for a second read and possible adoption.
